The following terms and conditions (T&Cs) form a legal agreement between you and the Commonwealth of Australia as represented by the Australian Trade and Investment Commission (Austrade) ABN 11 764 698 227. Your use of the ibrand site (Site), including its ibrand Creative Library (Library), is subject to these T&Cs.

Your use of the Library and the Site may be governed by additional terms and conditions, as notified to you from time to time by Austrade. Such notified additional terms and conditions will:

1. apply to your use of such parts of the Site or features in addition to these T&Cs; and
2. prevail over these terms and conditions to the extent of any inconsistency.

By using the Library, you acknowledge that you have read these T&Cs. If you do not agree to these T&Cs, you must not access the Library or Site.

Changes to these T&Cs

The version of the T&Cs applicable to your access to and use of this Site is the current version displayed on this Site at the time of access and use.

Austrade from time to time, may amend or update these T&Cs at its sole discretion. Prior to such changes becoming effective, Austrade will use reasonable efforts to notify you of any such change. By continuing to access or use this Site after such changes, you are deemed to agree to be bound by such changes.

Intellectual property rights

You acknowledge that all intellectual property rights (including copyright, patents, database rights and trademark rights) subsisting in, relating to, or arising out of this Site, the Library or the Images are owned by and vest in Austrade (or its licensors).

You acknowledge and agree that these T&Cs do not transfer any right, title, or interest in Austrade's (or its licensors) intellectual property rights other than as specifically outlined in these T&Cs.

Licence

Austrade grants you a revocable, non-exclusive, non-transferable, non-sublicensable, personal licence or sublicence to use the images contained in the Library (Images) for the permitted purpose identified by you in writing and agreed to by Austrade, at the time of your request for access to the Library. You must not allow any other person to use or enjoy any of the rights granted under this licence.

This licence will terminate in the following circumstances:

1. immediately upon the expiry of the agreed term of use;
2. upon your breach of the terms and condition; or
3. upon verbal or written notice to you by Austrade.

Use of Images

Images include:

1. photos
2. drawings
3. graphics
4. trademarks
5. any artistic or literary works
6. films
7. videos
8. sound recordings
9. information sheets
10. guidelines
11. templates and any other works, in whatever media presented, and whether protected by copyright, registered as trademarks or not.
     

• • You must use the Images in accordance with any Austrade guidelines and only for a permitted purpose, agreed by Austrade, including by way of a notice on this Site.
• • You must not use any of the Images in any derogatory or inappropriate context or in association with any derogatory or inappropriate material.
• • It is your responsibility to provide Austrade with details, in writing, of how the material will be used. The ways in which you use the Images may be limited or restricted, as notified to you by Austrade.
• • If you are uncertain of whether your use of an Image is subject to any restrictions or limitations, or whether your intended use of an Image is allowed, you must seek verification from Austrade before using the Image.
• • Upon completion of the permitted use, you must destroy or return all copies of any items obtained from the Library to Austrade.

Austrade brandmark

You must adhere to the Austrade brand guidelines when attaching the Austrade brandmark to any Images. Any use of Austrade’s brandmark by another organisation or individual requires a licence agreement.
